How do I make merchandise purchased abroad deductible?

It's necessary to have a customs declaration (pedimento) in your name that covers the merchandise you are buying from abroad, both to demonstrate legal importation and to deduct the expense for Income Tax purposes and to credit the VAT paid on the importation, in case you are not the final consumer.

What is the Importer Registry?

This registry is essential for importing merchandise into Mexico, as well as having a customs declaration (pedimento) that allows the cost to be deductible and the import VAT to be credited for purchases made abroad.

Is there any export registry one must be registered in?

In the vast majority of cases, there isn't a requirement to register in an Export Registry to export goods to other countries. What is a Customs Broker?

A customs broker is an individual who obtains a license from customs authorities to assist importers and exporters in conducting their foreign trade operations with Mexican Customs. Although not a public official, they are responsible for ensuring correct declaration of goods, payment of foreign trade taxes, compliance with applicable non-tariff regulations and restrictions, and adherence to appropriate procedures for customs clearance.

What is the difference between Import Coordination and Trading Company?

Import coordination is a service for clients already registered in the importer's registry but lacking a dedicated team for traffic or foreign trade operations. At Mexbuy, we offer these clients coordination of their shipments from origin to destination to ensure timely and cost-effective delivery. On the other hand, the trading company service includes the aforementioned plus registration in the importer's registry: the merchandise would be imported under our company's name for us to subsequently carry out domestic sales to our client.

Do I become a taxpayer in Mexico when selling through the Commercial Intermediation solution?

No, your company remains a simple foreign provider of the products sold in Mexico through our commercializer Mexbuy. Your foreign company does not acquire tax obligations in Mexico or generate a permanent establishment. Mexbuy is responsible for importing with due customs compliance and selling the merchandise in Mexico with proper tax compliance, generating electronic invoices with VAT in Mexico for buyers.

Can I recover import taxes and VAT in the Commercial Intermediation solution?

Yes, Mexbuy will transfer the import taxes and VAT paid by the foreign seller when making the sale in Mexico, which can be reimbursed after the sale is invoiced and the import VAT is credited against the VAT of the sale paid by the buyer in Mexico.

Are my sales subject to Income Tax and VAT withholdings when selling on ecommerce platforms in Mexico?

No, since Mexbuy is the importer and legally the seller of the product in Mexico, a duly registered legal entity before the Federal Taxpayers Registry and in compliance with its tax obligations, ecommerce platforms in Mexico are not required to withhold Income Tax or VAT on sales, as long as they receive Mexbuy's Fiscal Status Certificate as the seller in Mexico.

Can I sell merchandise in Mexico subject to NOM certifications or import permits?

Yes, Mexbuy, as your commercial intermediary in Mexico, will take care of managing and obtaining the permits and certifications applicable to import and sell merchandise in Mexico, from Official Mexican Standards to import permits from COFEPRIS or other Government agencies.
